By using the Cogl app, you agree to our terms of service and privacy policy.

Introduction

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the services ("Service") provided by Cogl ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Billing

The Service is billed in advance on a once-off, per teacher basis. This will grant a lifetime licence to use the Service, should the Service be available.

The Service is provided "as is" without warranty of any kind, express or implied. Payments are non-refundable.

Acceptable behaviour

You are forbidden from tampering with or modifing the appearance, functionality or code of the Service in any way.

A licence may consist of multiple teacher accounts. Each account may be used from up to 5 different IP addresses.

Uptime of service

The Service maintains a near 100% uptime. This is reliant on our excellent, third party host: Absolute Hosting.

We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use or downtime of the Service.

We shall not be held liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use our service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing law

You agree that all matters relating to your access or use of the Service, including all disputes, will be governed by the laws of the Republic of South Africa and the jurisdiction thereof. This applies even if the parties do not live in the Republic of South Africa and if the Terms were agreed to outside of the Republic of South Africa.
